In order for a hemp-derived CBD product to be legal, it must contain less than 0.3% THC. In states where cannabis or marijuana use is legal for recreational use, hemp-derived CBD can have higher levels of THC.
CBD products that have had all THC removed are legal in all 50 states, but CBD products with the federal legal limit of THC are still not legal in states like Idaho and South Dakota.
